Rep. Chip Roy Backs Trump Birthright Citizenship Never Meant for Illegal Immigrants Children
Texas Congressman Chip Roy voiced strong support for President Trump’s push to limit automatic citizenship at birth. He argued that the practice was never designed to cover offspring of those entering the country without permission or on short-term stays.
Birthright citizenship stems from the 14th Amendment ratified in 1868 after the Civil War. Lawmakers aimed to ensure citizenship for freed slaves and their descendants while overturning prior court rulings that denied it based on race.
The clause states anyone born in the United States and subject to its jurisdiction qualifies as a citizen. Courts have long interpreted this to include most children born on American soil regardless of parental status.
Debates over intent often focus on the era’s context with no federal illegal immigration laws yet in place. Supporters of restrictions claim the framers envisioned ties to the nation through lawful presence or allegiance.
Rep. Roy reportedly echoed these views in a recent statement aligning with Trump’s policy goals. His office highlighted historical records suggesting the amendment targeted those with permanent community bonds.
It is true that some original documents from the amendment’s debates show lawmakers excluding children of foreign diplomats or invading armies. However, the Supreme Court in 1898 ruled in favor of citizenship for a child of Chinese immigrants who were legal residents at the time.
